Important: These Terms include provisions that limit our liability to you and require you to resolve disputes with us through arbitration on an individual basis, not as part of any class or representative action.

Client Contact AI provides artificial intelligence-powered chat automation services designed to help businesses, healthcare practices, and professionals manage patient/client communications, schedule appointments, and automate responses.

2.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Eligibility

To use our Service, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Represent a legitimate business or professional practice
  • Not be prohibited from using the Service under applicable laws
  • Comply with all applicable healthcare regulations if using for medical purposes

4. Account Registration and Security

5. Subscription and Payment Terms

5.1 Subscription Plans

We offer various subscription plans with different features and pricing. Plan details, including features and pricing, are available on our website and may be updated from time to time.

5.2 Payment

  • Billing: Subscriptions are billed in advance on a monthly or annual basis
  • Payment Methods: We accept major credit cards and other payment methods as indicated
  • Automatic Renewal: Subscriptions automatically renew unless cancelled
  • Price Changes: We may change subscription fees with 30 days' notice
  • Taxes: Prices do not include applicable taxes, which are your responsibility

5.3 Free Trial

We may offer a free trial period for new users. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

5.4 Refund Policy

All fees are non-refundable except as required by law or as expressly stated in these Terms. If you cancel your subscription, you will continue to have access until the end of your billing period.

You can cancel your subscription at any time from your account settings or by contacting billing@clientcontact.ai. Cancellations take effect at the end of the current billing period.

5.5 Payment Disputes

If you believe you have been incorrectly charged, contact us within 30 days of the charge. We will investigate and work with you to resolve the issue.

6. Acceptable Use and Restrictions

6.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. The Service is designed for business and professional use.

6.2 Prohibited Activities

You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit harmful code, viruses, or malware
  • Attempt to gain unauthorized access to our systems

7.2 Your Content

You retain all rights to the content you submit through the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display Your Content solely for the purpose of providing and improving the Service.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, we may use them without any obligation to you. You grant us all rights to use such feedback for any purpose.

7.4 Trademarks

Client Contact AI name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Client Contact AI. You may not use them without our prior written permission.

8. Data Protection and Security

We process your data in accordance with our Privacy Policy. For healthcare providers, we maintain HIPAA compliance and execute Business Associate Agreements (BAAs) as required.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

9.2 No Warranty of Accuracy

We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The AI responses will always be accurate or appropriate

9.3 Third-Party Services

The Service may integrate with third-party services. We are not responsible for the availability, accuracy, or content of such third-party services.

AI Limitations: Our AI agents are trained to provide helpful responses, but they are not perfect. Always review AI-generated responses for accuracy and appropriateness, especially in healthcare contexts. The AI should not be relied upon for medical advice or emergency situations.

10. Limitation of Liability

10.1 Damages Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIENT CONTACT AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10.2 Maximum Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Client Contact AI, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your Content and its use by us
  • Your violation of applicable laws or regulations

12. Termination

12.1 Termination by You

You may terminate your account at any time by cancelling your subscription through your account settings or by contacting us. Termination will be effective at the end of your current billing period.

12.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

12.3 Effect of Termination

Upon termination:

  • Your right to use the Service will immediately cease
  • We will delete your account and data in accordance with our data retention policy
  • You will not be entitled to any refund of fees already paid
  • All provisions that should survive termination will continue to apply
Data Export: Before terminating your account, you should export any data you wish to retain. We provide data export tools in your account settings. After termination, we may delete your data in accordance with our retention policies.

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@clientcontact.ai. We'll try to resolve the dispute informally by contacting you via email.

13.2 Binding Arbitration

If we can't resolve the dispute informally, you and Client Contact AI agree to resolve any claims relating to these Terms or the Service through final and binding arbitration, except as set forth below.

13.3 Arbitration Procedures

  • Arbitration will be conducted by the American Arbitration Association (AAA)
  • The arbitration will be held in San Francisco, California or another mutually agreed location
  • The arbitrator's decision will be final and binding
  • Each party will bear its own costs of arbitration

13.4 Exceptions to Arbitration

Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Service or intellectual property infringement without first engaging in arbitration.

13.5 No Class Actions

You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or class member in a class, consolidated, or representative action.

13.6 Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the new Terms on this page
  • Updating the "Last Updated" date
  • Sending you an email notification (for significant changes)
  • Displaying a prominent notice in the Service

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the new Terms.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice.

15.5 Force Majeure

We shall not be liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control.

15.6 Export Compliance

The Service may be subject to export laws and regulations. You agree to comply with all applicable export and re-export control laws and regulations.

15.7 U.S. Government Rights

If you are a U.S. government entity, the Service is a "commercial item" as defined in FAR 2.101 and is provided with only those rights as are granted to all other end users.
